Stewards convened an Inquiry on the 31st October 2009 in relation to the urine sample numbered 279048 taken from the greyhound “ELUSIVE SHADOW” which competed on the 5th of September 2009 at the Rockhampton Greyhound Racing Club in Race 2 (placed 4th) and subsequently returned positive to the drug Hydroxystanozolol.
Stewards directed Mr. S. Plunkett of Miriam Vale, the Trainer of the greyhound at the time of the race to appear.
Evidence was taken from Mr. Plunkett, along with a number of written submissions accepted as exhibits.
Stewards charged the Trainer under R 83 (2) (a) (d) which states;
(2) The owner, trainer or person in charge of a greyhound
(a) nominated to compete in an Event
(d) shall present the greyhound free of any drug
Mr. Plunkett pleaded not guilty.
Mr. Plunkett was found guilty as charged by Stewards.
Mr. Plunkett was Suspended for 6 months and fined $750
Stewards disqualified the greyhound “ELUSIVE SHADOW” under R 83 (4) from Race 2 (placed 4th) at the Rockhampton Greyhound Racing Club meeting on the 5th of September 2009. Any Prizemoney resulting from that race must be returned to Greyhounds Queensland.
Mr. Plunkett was read his rights of Appeal at the conclusion of the Inquiry.
Local Rule 26(QLD)= unless the Authority determines otherwise-
- a greyhound trained on or at premises at which a disqualified or suspended person resides shall not be eligible to compete in any event;
- a greyhound owned or trained by a disqualified or suspended person as at the date of the suspension or disqualification or at any time since the date of the offence resulting in the suspension or disqualification, shall not during the period of suspension or disqualification be owned or trained by the spouse or partner of the suspended or disqualified person or by any person who resides at the premises at which the suspended or disqualified person resides.
